The recently appointed Chief Justice of India, Justice R M Lodha said that adjournment with respect to hearing in cases would not be ordered on the mere request from lawyers. “The culture of adjournment has to go. Seeking adjournment of scheduled hearing of cases at the drop of a hat must go. Unless a lawyer falls very ill, the requests for adjournment must not be made,” said, the CJI.
Justice Lodha made the strict observation while he was heading a three judge bench and was asked for adjournment of scheduled hearing on Monday by Advocate Shivaji M Jadav, who is also president of Supreme Court Advocates on Record Association.
Justice Lodha also ordered a new process according to which the request for adjournment will now have to be made “much in advance” and decision regarding it shall be taken by the Registrar of the Supreme Court. Justice Lodha also expressed his displeasure at wasting of judicial time on such issues.
